NOTE: This office does not prepare any documents; we are record keepers only. We do not provide any forms. We do not change any information on any document. All recordings must meet requirements as stated below.

Documents recorded on or after July 1, 2002 must meet GS 161-14(b) as follows:

  • Original must be presented on 8 ½ x 11” or 8 ½ x 14” paper.
  • Have a 3 inch blank margin at the top of the first page and ½ inch blank margin on remaining sides of first page and on all sides of subsequent pages.
  • Black type on white paper with font no smaller than 10 points in size.
  • Only one sided typed or printed text.
  • Type of instrument at top of first page below blank margin.

Filing a non-standard document that does not meet the above requirements will be subject to a $25.00 non-standard fee in addition to regular recording fees for any instrument presented for registration.

State excise tax (revenue) is required to be paid on deed transactions conveying an interest. This tax is calculated at $2 per $1000 of the sales price.

Effective March 7, 2011: All deeds must be presented to the Tax Collector’s Office for certification of no delinquent property taxes. The collector’s office requests Parcel Identification Numbers (PIN) for timely processing.

Jackson County Land Records requirements for deeds, per GS 105-303A & GS 105-317.2:

Deeds presented to land records for approval must contain the following:

  • Name and address of preparer (must be an individual's name or law firm's name - and must be on the first page of the document)
  • Name and address of each grantor and each grantee
  • Property description sufficient to identify parcel to be transferred:
  • metes and bounds description OR Plat cabinet and slide reference
  • back deed references of the grantor
  • A statement whether the property includes the primary residence of a grantor

New per NC General statutes as of January 2010:

Deeds involving property splits must either refer to a recorded survey showing the split, or have signature of approval from the Jackson County Planning Department.

  • Deeds, Agreements, Assignments, Modifications, Releases, Assumed Names, Power of Attorneys, etc,; recording fees $26.00 for first 15 pages - $4.00 for each additional page. 
  • Deeds of Trust recording fees: $64.00 for first 35 pages - $4.00 for each additional page.
  • Deed excise tax $2.00 per $1000 (based on sales price).
  • Satisfactions - no charge.
  • Plat recording fees $21 (Please call office for details on recording process of all plats).
  • UCCs: $38.00 for 2 pages, $45.00 for 3-10 pages, add $2.00 for each additional page. $38.00 for all terminations.
